Abstract

The development policy for the Nusantara Capital City (Ibu Kota Nusantara- IKN) is based on Law No. 3 of 2022 concerning IKN is planned to go through 5 stages of development from 2022 to 2045. The first stage is essential for the development of IKN to occur in 2022-2024. The transfer of the Indonesian capital city from Jakarta to Paser Penajam Utara Regency and Kutai Kartanegara Regency, East Kalimantan Province requires approximately 256,142 hectares of land. The problem is, in that area, there are lands owned by the indigenous people. There is a concern that the development of the IKN will forcibly move the indigenous peoples from their land. Certainty of ownership of land rights is important for indigenous and tribal people because it is related to livelihoods, biodiversity conservation, and group and cultural identity. This paper aims to examine how to minimize the land problems of indigenous people at the IKN development stage. Through a qualitative approach with a descriptive-analytic method, the results of the study show the need for efforts to protect the indigenous people. Efforts that need to be taken include finalizing the Indigenous Peoples Bill, establishing Association Legal Entities for indigenous peoples, recognizing the existence of indigenous peoples and their assets through regional regulations, providing alternative livelihoods for indigenous peoples, building facilities for customary law communities, resolving overlapping IKN land and the land of indigenous people, as well as the relocation of indigenous people, if necessary.
